Derek focuses his practice on trademark prosecution, enforcement and licensing. Known for his ability to convey complex concepts to clients in a meaningful and understandable manner, he guides his clients through the trademark registration process and provides key insights to  to defend the trademark rights of his clients while simultaneously enhancing their brands.

Derek has represented clients across many industries including health and wellness, retail, education, alcohol and beverage, gaming, and consumer goods. Within these industries, he has comprehensively and successfully represented clients before the U.S. Patent and Trademark Office and the Trademark Trial and Appeal Board. Derek also assists clients with commercial transactions, business formation and equity financing. 

    Experience:

    • Trademarks: Manages portfolio of over 300 trademarks for both domestic and international brands, including formulating a robust filing and enforcement strategy
    • Licensing: Drafted and negotiated sponsorship and licensing agreements for use of client software platform during by major fashion company during large runway event in NYC and Los Angeles
    • Commercial Agreements: Drafted and negotiated master service agreements between client software development company and global human resources platform
    • Trademark Defense and Enforcement: Developed sound defense strategy and cease and desist response to claims of infringement from large dietary supplement brand against client, avoiding litigation and allowing for coexistence of brands.
